TrailerTREK TOWBARS Ltd - “Leading The Way In Mobile Towbar Fitting Across The UK.

Trailertrek Ltd - Terms and Conditions.


1.1 - All terms and conditions are governed by and construed in all respects in accordance with the


laws of England. You irrevocably submit to the exclusive jurisdiction of the Courts of England.


1.2 - Your statutory rights are not affected.


2.1 - The placing of an order, or booking of a fitting will be deemed as an acceptance of our Terms


3) Cancellation’s and Lateness.


3.1 – Any cancellations within 48 working day hours of fitting time and date, will incur a 50% charge


3.2 – The Customer agrees to pay a £15 charge to be added to any job total in the event where the


customer is more than 15 minutes late for their installation slot.


3.3 – Trailertrek Ltd reserve the right to refuse to fit to any vehicle. This will be at the fitter’s


discretion. We accept no liability for any costs incurred by a customer should their car be deemed as


one that is unable to be fitted to.


3.4 – Trailertrek Ltd reserve the right to cancel or re-book any fitting. We accept no liability for any


costs incurred by a customer should this situation arise.


3.5 - All cancellations must be in writing, without exception and received within 48 working hours (Mon - Fri) prior of fitting time and date and will incur a 35% cancellation charge  to cover carriage and suppliers handling charge.  When booking this forms part of your acceptance and conditions to supply and install.  By making a booking with Trailertrek you agree to these terms and conditions.


3.6 - If you are supplying your own towbar and electrics and require only a fitting service please ensure you have ordered the correct parts as a 50% charge is applicable if we are unable to fit due to incorrect parts or corrosion to the vehicle mounting.


3.7 - All booking are confirmed by email and if we are unable to fit due to incorrect details being given or customers non-attendance, a 50% charge is applicable.


4.1 – Trailertrek Ltd shall not be held liable for any failure to perform obligations due to force


majeure. Following notification by us to you of such cause, we shall be allowed a reasonable


extension of time for performance of any obligations. For the purpose of this term, force majeure


means fire, explosion, flood, lightning, an act of God, act of terrorism or events or circumstances


outside of reasonable control by Trailertrek Ltd.


5) Specification and Installation.


5.1 – Customers are required to provide Trailertrek Ltd with the correct vehicle description at


time of booking/ordering. Make, Model and year refer to the production of a vehicle. This will


not necessarily be the actual date of registration of the vehicle. If clarification is required, it is


the customer’s responsibility to seek out the correct information from the manufacturer prior to


booking. If an incorrect product is supplied due to incorrect information or specifications given by


a customer, then the customer agrees to allow Trailertrek Ltd to exchange the incorrect goods for


the correct product and rearrange the fitting. Should an order/fitting be cancelled or rearranged


due to incorrect vehicle details provided by a customer, Trailertrek Ltd reserve the right to apply an


additional fee of £50 to the current job total to cover our costs. Trailertrek Ltd accept no liability for


any costs incurred by the customer.


5.2 – All dealership requirements must be expressly stated at time of booking. Reliance falls on the


customer to seek out any dealership stipulations prior to booking. Trailertrek Ltd accepts no liability


for loss of warranty, or any other costs incurred by the customer.


5.3 – Certain vehicles may require further decoding or diagnostic work at a dealership following


the installation of dedicated electrics. Trailertrek Ltd accept no liability for any costs incurred by a


customer should this be required.


5.4 – It is the customer’s responsibility to ensure that any products requested or fitted fully comply


with any specifications required by an M.O.T. test and that all goods are used in compliance with


all laws within whichever country you are travelling in. Some vehicles may require a tow ball to be


removed when a customer is not towing or has an M.O.T. test. Trailertrek Ltd accept no liability for


costs incurred due to a customer’s failure to follow advice or adhere to any legislation.


5.5 – Trailertrek reserve the right to amend a quotation upon installation should the installation


require further work than was requested by the customer and quoted for in our original quotation.


This includes the removal and reinstallation of any ply-lining or any additional non-factory fitted


interior or accessories on any vehicle.


5.6 – If an installation address is changed, Trailertrek reserve the right to alter any quotation


5.7 – Trailertrek accept no liability for any costs incurred by a customer in the event of an incorrect


part or a damaged part being taken to an installation.


5.8 – Any time or date for installation or delivery, given by Trailertrek is given in good faith but is an


estimate only. Trailertrek does not accept liability for any costs incurred by a customer for a late


6.1 – Unless expressly stated by the Management, full payment is due upon completion of a fitting


or in instances of supply only, payment is due upon ordering of the goods.


6.2 – Title to goods shall not pass to a customer until full payment has been received, but even


though title has not passed, Trailertrek shall be entitled to sue or proceed with debt collection


proceedings for the amount owed once its payment has become due.


6.3 – In the event of debt collection proceedings commencing, the customer agrees to pay a £50


administration charge, in addition to any amount already due.


7.1 – If for any reason beyond our control we are unable to supply a particular item to a customer,


Trailertrek does not accept any liability for costs incurred by the customer for the non-supply of the


7.2 – If for reasons beyond our control Trailertrek are unable to perform a customer’s request, the


customer agrees to allow us a reasonable extension of time for performance to be completed.


8.1 – Trailertrek cannot supply exact dates or times for delivery. Once in the hands of a carrier, it


is the carrier’s responsibility to attain the target delivery time. Trailertrek does not accept liability


for any costs incurred by a customer due to a delay of a delivery. Trailertrek will not disclose any


carrier’s details on request. A customer must contact Trailertrek, who will contact the carrier


regarding a delayed delivery.


8.2 – Non-receipt of goods must be reported to Trailertrek within five days of expected delivery


date. Trailertrek accepts no liability for costs incurred by a customer due to the non-delivery of


9.1 – Trailertrek will not accept returns, unless the item is defective or not as described.


9.2 – Trailertrek will not accept returns if any part of the goods has been constructed.


10.1 – Trailertrek Ltd will replace any goods proved to our satisfaction to have been damaged in


transit, provided that we are notified in writing, within 5 days of delivery, of the occurrence of the


damage and if practical the nature and extent of the damage. Trailertrek accept no liability for any


costs incurred by a customer due to an item being damaged in transit.


10.2 – For the purposes of Clause 10.1 above. In writing includes both written letters and e-mail


communication addressed to the Complaints Department. Mobile communication via text will not


11) Guarantee’s and Rectifications.


11.1 – All vehicle electrics fitted by Trailertrek Ltd are covered by a 12 month guarantee.


11.2 – Any guarantee offered by Trailertrek Ltd will cease immediately should the customer, or any


other third party, interfere with any electrics or goods supplied and/or installed.


11.3 – Any guarantee offered by Trailertrek Ltd is offered to the purchasing customer only. Any


subsequent owners will not be covered under any guarantees from Trailertrek.


11.4 – Trailertrek Ltd will pass any third party guarantee on, in full, to any purchasing customer. This


guarantee will cease should the vehicles ownership be transferred.


11.5 – In the respect of goods manufactured and supplied to Trailertrek by third parties, Trailertrek


will pass on to the customer (in so far as possible) the benefit of any warranty given by such third


parties and will (upon request) supply details of the Terms and Conditions of warranty’s and copies


of any product sheets issued by a third party.


11.6 – With regards to installation or information passed from third parties or manufacturers,


Trailertrek cannot be held responsible for any inaccuracies within this data, and an items installation


instructions take precedence.


11.7 – Trailertrek reserve the right to charge a customer a call out fee of £50 if on attendance to


a rectification request, no issue is found, or the issue is of the extent which is covered by basic


maintenance of any vehicle, misuse or neglect.


12.1 – Trailertrek does not accept responsibility or liability for any damage to any equipment in


which our products are used for purposes other than for those of which it was designed.


12.2 – Trailertrek does not accept liability for damage to a customer’s vehicle or property once


the customer has signed on completion of an installation to say no damage has been caused. Any


damage must be reported prior to signing a job completion sheet. Once a job completion sheet has


been signed, Trailertrek will not accept any liability for any damage caused to vehicles or any other


12.3 – Trailertrek does not accept liability for damage to vehicles caused by the weather during an


13.1 – All prices/quotes include VAT at the statutory rate current at date of invoice. Trailertrek Ltd


reserve the right to alter prices or quotations at any time without prior notice.


13.2 – Trailertrek does not accept liability for any loss of earnings, profit, business, contracts,


revenue or any consequential loss of any nature whatsoever.
